Terms of Service

By using the AutomationTool post-processor questionnaire service ("the Service"), you agree to the following terms. These Terms of Service constitute a legally binding agreement between you ("User") and AutomationTool ("Company") under the Indian Contract Act, 1872. If you do not agree, do not use the Service.

1. Service Description

AutomationTool provides a web-based questionnaire for submitting CNC post-processor development requests. The Service collects machine specifications, generates a PDF summary, packages deliverables into a ZIP archive, and tracks request status. The Service is hosted on Cloudflare Pages infrastructure and utilizes Supabase for database storage and Google Workspace for file management.

4. Intellectual Property

You retain all rights to the machine specifications, CAM files, and reference materials you submit. The post-processor deliverables developed by AutomationTool are provided under a separate license agreed upon between the parties. The Service interface, branding, underlying technology, and generated PDF templates are the intellectual property of AutomationTool and are protected under Indian copyright and intellectual property laws.

5. Fees and Payment

The use of the questionnaire and tracking portal is free. Fees for post-processor development services are agreed upon separately between AutomationTool and the customer. All fees are exclusive of applicable taxes, including GST, which shall be borne by the customer.

6. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. AUTOMATIONTOOL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID (IF ANY) FOR THE SPECIFIC REQUEST GIVING RISE TO THE CLAIM. THIS LIMITATION APPLIES TO THE FULLEST EXTENT PERMITTED BY INDIAN LAW.

7. Indemnification

You agree to indemnify, defend, and hold harmless AutomationTool, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable Indian law, including the IT Act, 2000.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control. We shall not be liable for any downtime or loss of data resulting from such unavailability.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiations. If negotiations fail, disputes shall be subject to the exclusive jurisdiction of the courts in [City, State], India. All disputes shall be resolved in accordance with the Arbitration and Conciliation Act, 1996, by a single arbitrator appointed by mutual consent.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or applicable Indian law. Upon termination, your right to use the Service immediately ceases.

In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021:

Any complaints or grievances regarding the Service or content should be addressed to the Grievance Officer. We will acknowledge receipt within 24 hours and resolve the grievance within 15 days.

12. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be notified via the Service or email. Continued use of the Service after changes constitutes acceptance of the new terms.

13. Entire Agreement

These Terms constitute the entire agreement between you and AutomationTool regarding the Service and supersede all prior agreements and understandings, whether written or oral.
